Can I sell my house in El Sobrante without an agent?

Yes. California law lets you sell your own home without hiring an agent. What you give up is the help: in El Sobrante you still owe the buyer the state disclosures, a West County Wastewater sewer certificate and the county transfer tax, and you run the pricing, showings and negotiating yourself.

Here’s the honest list, so you can decide with your eyes open.

Is it legal to sell my own house in California?

Yes. California’s Real Estate Law requires a license for someone who sells or negotiates a sale “for another or others” for pay (Business and Professions Code 10131, as quoted in the California Department of Real Estate advisory on licensed activities, checked October 2026). Selling your own home isn’t acting for someone else.

The disclosure duty doesn’t go away, though. The DRE’s Real Estate Reference Book says the duty to prepare and deliver disclosures sits with “the seller and the seller’s agent” (DRE, Reference Book, Chapter 20, checked October 21, 2026). With no agent, that job is all yours.

What disclosures do I have to give the buyer?

The same ones an agent would hand over. You fill them out and deliver them. For a home of one to four units, the DRE Reference Book lists these among the main ones:

  • Real Estate Transfer Disclosure Statement (TDS). Your written description of the home’s condition, covering what you know and what a reasonably diligent look at the home would show (Civil Code 1102.3, as summarized by the DRE). If you deliver a required disclosure after the buyer’s offer is signed, the buyer may have three days after hand delivery, or five days after mailing, to cancel in writing.
  • Natural Hazard Disclosure Statement (NHD). Covers state-mapped zones such as earthquake fault zones, seismic hazard zones, fire hazard areas and flood areas (Civil Code 1103 and following). Many sellers pay a third-party company to prepare it. In El Sobrante this one matters: the California Geological Survey’s 2024 report maps landslide zones on El Sobrante Ridge and San Pablo Ridge slopes and liquefaction zones in the San Pablo Creek valley (CGS, Seismic Hazard Zone Report 134, official map February 22, 2024). Look up your address on the state’s free EQ Zapp map.
  • Smoke detector and water heater bracing statement. Unless the sale is exempt, the seller gives the buyer a written statement of compliance before escrow closes, per the same DRE chapter.

The DRE also lists exemptions, such as foreclosure sales, court-ordered transfers, transfers to a spouse and transfers from one co-owner to another. A regular owner sale to an outside buyer isn’t one of them.

If the home was built before 1978, federal law adds one more. The EPA’s Lead-Based Paint Disclosure Rule requires sellers to share what they know about lead-based paint and lead hazards before the buyer signs a contract (U.S. EPA, Real Estate Disclosures About Potential Lead Hazards, checked October 2026).

One caution. This isn’t the full list, and the DRE itself says disclosure requirements can change. Get current forms, and have a real estate attorney review your disclosures before you deliver them. What you leave out can follow you after closing.

What El Sobrante steps can’t I skip?

Two local ones. Neither cares whether you have an agent.

The West County Wastewater sewer certificate. WCW says anyone selling or transferring a home in its service area needs a sewer lateral Certificate of Compliance before the sale. The line gets cleaned and video inspected, you notify WCW at least 24 hours before testing, and you pay for any repair WCW calls for. Repairs outside the house need a WCW permit (West County Wastewater, Residential page, Sale of Property, checked October 2026). Start this before you list. Email [email protected] or call (510) 222-6700.

Which transfer tax you owe. El Sobrante has no city government. Unincorporated addresses pay only the countywide documentary transfer tax, $0.55 per $500 of value, rounded up to the nearest $500 (Contra Costa County Clerk-Recorder, Documentary Transfer Tax page, checked October 2026). At Redfin’s August 2026 El Sobrante median of $714,527, that’s about $790.

Some homes with El Sobrante mailing addresses sit inside Richmond city limits. There, the recorder also collects Richmond’s city tax on the full value, $7.00 per $1,000 under $1 million (Contra Costa County Clerk-Recorder, City of Richmond page, checked October 2026). That’s about $5,000 more at the median. Our page on whether your El Sobrante home is in Richmond or the county shows how to check your parcel. Who pays which tax is set in the purchase contract. Ask escrow for your exact figure, and a tax professional about the rest.

Who handles escrow and title if there’s no agent?

You and the buyer pick an escrow company, and a title company issues the title policy. Escrow holds the deposit, collects the signed documents, figures each side’s costs and records the deed. It follows your written instructions. It doesn’t negotiate for you or tell you whether a term is good for you.

So the purchase contract matters more when you’re on your own. Ask a real estate attorney which contract form fits your sale, and have them review it before you sign. Nobody else in the deal is checking it for you.

How do I price it without an agent?

Start from real El Sobrante sales, not a guess. In August 2026 the median El Sobrante home sold for $714,527, up 8.7% from a year earlier, at $511 per square foot. There were 41 sales, a median of 19 days on market, and a sale-to-list ratio of 101.9%. Also, 57.6% sold above list and 20.3% of listings cut their price (Redfin, El Sobrante housing market page, August 2026, checked September 24, 2026).

That’s a citywide median. Your price comes from the few closest sales that match your lot, slope, size and condition. A flat yard on a quiet street and a steep lot off San Pablo Dam Road aren’t the same product. If you price high and cut later, you’re in that one-in-five group.

What does an agent do that I’d be doing myself?

Pricing, prep, photos, getting the listing in front of buyers, showings, screening offers, negotiating, and keeping escrow on schedule. Some owners handle all of that fine, especially if they’ve sold before and the house is ready to show.

The money question has two parts:

  • Listing side. Commissions are always negotiable and are never set by law. The DRE says any agent claiming a “standard” rate is misrepresenting the law (DRE Consumer Alert, Changes to Real Estate Representation, November 14, 2024, checked October 2026).
  • Buyer side. If the buyer has their own agent, the same DRE alert says a buyer may ask the seller to pay some or all of their agent’s pay as a concession, and the seller can accept or reject it. Selling on your own doesn’t stop that request from showing up in an offer.

Will an agent get you a higher price? We don’t have a named source with El Sobrante numbers on that, so we won’t claim it. What an agent does is take on most of the work and help keep the paperwork on track. You still sign the disclosures either way. There are also middle options, like a flat-fee listing. Our comparison of selling options lays out the trade-offs.

Questions people also ask

Do I need a lawyer to sell my house without an agent in California?

That’s a question for an attorney, but here’s why owners selling alone often hire one. Without an agent, nobody on your side reviews the purchase contract or your disclosures. A real estate attorney can check both before you sign. Escrow follows instructions and records the deed, but it doesn’t advise you.

Do I still need a sewer inspection if I sell by owner in El Sobrante?

Yes. West County Wastewater requires a sewer lateral Certificate of Compliance before any sale or transfer in its service area, which includes El Sobrante, with or without an agent. That means cleaning, a video inspection WCW reviews and any repairs it requires, per WCW’s Residential page checked October 2026. Call (510) 222-6700 early.

Do I have to pay the buyer’s agent if I sell my house myself?

Not automatically. The DRE’s November 2024 consumer alert says a buyer may ask the seller to cover some or all of their agent’s pay as a concession, and the seller can accept or reject it. Commissions are always negotiable and never set by law. Weigh any request against the price and terms of the whole offer.

If I sell my house as-is by owner, do I still give disclosures?

Yes, unless the sale fits an exemption. The DRE Reference Book lists exemptions like foreclosures, court-ordered sales, transfers to a spouse and co-owner transfers. Selling as-is isn’t on that list, checked October 21, 2026. As-is means you won’t make repairs. It doesn’t mean you skip telling the buyer what you know. Have a real estate attorney review your forms.
